2.1 Scope: These Terms govern all use of the Service via the internet, mobile devices or any other platform.
2.2 Acceptance: By creating an Account, purchasing Tokens or using the Service, you acknowledge that you have read, understood and agree to be legally bound by these Terms and by the accompanying Refund Policy, Privacy Policy and Cookie Policy. If you do not accept all of these documents, you must not use the Service.
2.3 Language Clause: Only the English version of these policies has legal force; translations are provided purely for convenience.
2.4 Eligibility & Jurisdiction: You must be at least 18 years old (or the age of majority in your jurisdiction) and legally permitted to use the Service. You may not access the Service from jurisdictions where AI‑generated digital content is prohibited.
3.1 Registration: Users must register using a valid email address and password, providing accurate and complete information. You are responsible for protecting your login credentials and for all activity under your Account.
3.2 Closing Accounts: You may close your Account by contacting the Company. Before closure, ensure there are no outstanding transactions and no unused tokens. The Company may close accounts for violations of these Terms, suspected fraud or where required by law.
4.1 Tokens: Tokens may be purchased with euro (EUR) and serve as the in‑platform currency for generating or downloading 3D models. Tokens are non‑transferable and hold no real‑world monetary value.
4.2 Ownership and Rights to Generated Content: All digital works you create using the Service (including 3D models and other outputs) are your exclusive property. The Company does not claim any intellectual‑property rights over your generated content and hereby assigns to you whatever rights it may have in those outputs. You are free to use your generated content for any lawful purpose—personal or commercial—provided you comply with these Terms and applicable laws.
4.3 Licence to the Company: By submitting prompts and generating models, you grant the Company a non‑exclusive, worldwide, royalty‑free licence to use, reproduce, store, and display your input and generated content solely as needed to operate, maintain, improve, and moderate the Service. This limited licence enables us to deliver the models to you and monitor compliance with our content policies.
4.4 Scope of Rights: This ownership clause covers only the outputs you create; it does not grant you rights to the platform's source code, underlying algorithms, training data, or any pre‑existing content owned by the Company or its licensors.
4.5 Pricing & Currency: Prices per token or model are listed in EUR. If you pay in another currency, your bank may apply conversion rates and fees. Prices may change without affecting completed purchases.
4.6 Payment Methods: Accepted methods include Visa, Mastercard and other options that might be added later.
4.7 Payment Gateway & Card Data: All transactions are processed by independent third‑party payment providers; Itemare OÜ does not collect or store your card details and does not sell or disclose them.
4.8 Issuer Fees: Your bank or card issuer may charge additional processing or currency conversion fees; such fees are your responsibility.
Users must use the Service responsibly and comply with applicable laws. You must not generate or upload content that:
You must also refrain from fraud or abusive language. Violations may result in removal of content, suspension or closure of your Account and, where necessary, reporting to authorities.
Users may request a refund within 14 days of purchase if tokens have not been used and digital content has not been delivered. The right of a refund ends once content has been generated or downloaded. For detailed procedures, see the Refund Policy.
The Company may modify or discontinue any feature or model at any time. Significant changes affecting existing purchases will be communicated, and users may receive a proportional refund or alternative content at the Company's discretion.
Complaints must be submitted via the specified contact method within 14 days of the issue, including account and order details. The Company aims to respond within 30 days. Unresolved disputes may be referred to Estonian consumer authorities or the EU Online Dispute Resolution platform.
The Service and Digital Content are provided as is. To the fullest extent permitted by law, Itemare OÜ disclaims all implied warranties and limits its liability to the amount you have paid in the preceding 12 months. Nothing herein limits liability where such limitation is prohibited by law.
These Terms are governed by Estonian law. Disputes will be resolved by Estonian courts, unless consumer protection laws require otherwise. EU consumers may use the EU Online Dispute Resolution platform.
